The Supreme Court on Friday dismissed an appeal filed by a member of the House of Representative, Eseme Eyiboh representing Eket Federal constituency in Akwa Ibom State.
Mr Eyiboh had gone to the apex court to challenge the ruling on the appeal brought to the Appeal Court by Dan Bassey Abia, challenging the ruling of Justice Abdul Kafarati, on points of law and jurisdiction.

The supreme court which was preside by Justice Chukwuma Ene found that Mr Eyiboh’s appeal was lacking in merit on the grounds that the primaries produced him as a contestant for the House of Representatives election in Eket was illegal and that he ought not have contested the election in the first place.
The court then affirmed Mr Abia as the rightful candidate of the Peoples Democratic Party (PDP) and winner of the Eket Federal constituency election.
In the same vain the apex court sacked Muss Yusuf Nagogo of the Congress for Progressive Change (CPC) representing Nassarawa North Senatorial district on the grounds that the primaries that brought him to power was not recognised by his party.
The court which replaced Mr Nagogo with Solomon Ewuga also of the CPC, said that it is the prerogative of the party to decide its candidate in any election and since the party did not recognise the primaries that brought Mr Nagogo to power his election is null and void.
The court went on to order both the Senate President and the Speaker of House of Representative to immediately swear in the new lawmakers.
Both Misters Nagogo and Eyiboh were sworn in by the two chambers of the National Assembly based on section 281 of the constitution on the strength of a court judgment which can be considered in the absence of a certificate of return.
